Terms and Condition of B & B Evergreen Sales

TERMS:

• First delivery is COD.

• Wholesale customers must supply a tax-exempt number. All prices FOB from farm.

• All orders are COD unless proper credit has been established. Credit may take up to 8 weeks.

• A 2% per month service charge will be assessed against past due balances.

• Prices are subject to change without notice.

• March 10th, weather permitting, starts spring digging.

• The tree farm reserves the right to cancel orders if necessitated by conditions or acts of God beyond their control.

SHIPPING:

• All freight is COD. A check should be ready at the time of delivery.

• Shipping will be arranged by the most reliable and regular carrier.

• Any customer wishing to pick up their order or have their carriers pick up, we are not responsible for the load once it leaves the farm location.

• All customers are asked to have adequate help at the time of delivery. Excess time will be charged at approximately $50.00 per hour.

• A $50.00 drop charge will be added for extra stops.

CLAIMS AND WARANTY:

• Inspect your order for damages and shortages.

• The driver should be made aware of any count discrepancies or damaged material, and these should be noted on the bill of lading.

• Please do not rely on the truck driver to report your concerns to Plant Retrievers, as s/he is not an employee of Plant Retrievers.

• Report damages and shortages by phone (800) 804-9995 or written fax (302) 337-7059 within 3days after delivery.

• No trees will be warranted unless untied at the time of delivery.

• We assume no responsibility for growth, productivity, results obtained in transplanting, possible windburn during shipping or damage due to handling by the buyer or buyer’s customers.
